In the Scottish court, an executry bond is required before a person can be confirmed as an executor. The courts also require a bond before they'll grant confirmation on intestate estates.
This bond guarantees that the executor will pay those they are legally obliged to from the estate. For example, legally-entitled creditors and beneficiaries.
The bond is a guarantee to those creditors and beneficiaries. It does not protect, insure or indemnify the executor.
We work with solicitors to help ensure bonds are issued correctly.
For a straightforward case, the price for a caution amount of £100,000 is £270.
For caution amounts over £250,000 and up to £2.5 million, please contact us.
